RushRooms - Rental Platform

Seller Policy – RushRooms (The Revolution of Renting & Selling)

RushRooms platform and application are owned and operated by Rush Rooms Real Estate Company. This Seller Policy governs the relationship between the Seller and the Platform and outlines the rights, obligations, and responsibilities related to listing and selling products or services through RushRooms.

1. Acceptance of the Policy

Creating an account or listing any product or service for sale on RushRooms constitutes the Seller’s explicit and final agreement to comply with this Policy, the Terms & Conditions, and all other policies and regulations adopted by the Platform.

2. Eligibility to Sell

The Seller must be the lawful owner of the product or be legally authorized to sell it and must possess full legal capacity to conduct sales transactions.

The Seller warrants that all information and data provided to the Platform are accurate, complete, and up to date.

3. Licenses and Permits

The Seller bears full responsibility for obtaining all licenses, permits, approvals, and regulatory authorizations required to conduct their business, sell their products, or provide their services.

Any product or service requiring a governmental license, permit, or authorization may not be listed unless all required approvals have been obtained from the relevant authorities.

Rush Rooms Real Estate Company and RushRooms shall not be liable for any violations, claims, damages, penalties, or losses arising from the Seller’s failure to obtain the required licenses or comply with applicable laws and regulations.

4. Identity Verification and Documentation

RushRooms reserves the right, at any time, to request documents, records, information, or evidence necessary to verify the Seller’s identity, ownership of products, legality of activities, or accuracy of submitted information.

The Platform may suspend the account or restrict access to certain services until the required verification process is completed.

5. Seller Responsibility

The Seller bears full legal, financial, and operational responsibility for all products, services, advertisements, listings, and content published through their account.

The Seller is solely responsible for the accuracy of all images, prices, specifications, descriptions, and information published in their listings.

6. Product and Service Accuracy

The Seller must ensure that all products and services accurately match the descriptions, specifications, images, and information displayed in the listing.

The Seller must disclose any defects, damages, limitations, or material information that may affect the Buyer’s purchasing decision.

Providing false or misleading information, concealing defects, or displaying inaccurate images constitutes a serious violation of Platform policies.

7. Prohibited Products and Services

The Seller may not list or sell any products or services that violate the laws and regulations of the Kingdom of Saudi Arabia, intellectual property rights, or applicable commercial regulations.

Counterfeit, stolen, unauthorized, prohibited, or unlicensed products and services, or any products or services that may expose users or the Platform to legal liability, are strictly prohibited.

8. Intellectual Property Rights

The Seller bears full responsibility for all images, texts, logos, trademarks, and content published through their account.

The Seller undertakes not to infringe upon any intellectual property rights, copyrights, trademarks, or other proprietary rights belonging to any third party.

9. Order Fulfillment

The Seller must fulfill orders and deliver products or services in the condition and specifications advertised and within the agreed timeframe.

If the Seller is unable to fulfill an order for any reason, the Seller must immediately notify both the Platform and the Buyer.

10. Commissions and Fees

RushRooms shall be entitled to a commission of 5% of the transaction value for transactions processed through standard or direct payment gateways.

RushRooms shall be entitled to a commission of 11% of the transaction value for transactions processed through installment payment services or installment payment gateways.

The commission rates may be modified, or alternative rates may be agreed upon with specific sellers, merchants, or partners through separate written agreements, unless otherwise agreed in writing between the parties.

11. Circumvention of the Platform

The Seller is prohibited from attempting to complete transactions, redirect customers, or communicate with customers outside the Platform for the purpose of avoiding commissions, fees, or other charges owed to RushRooms.

If such conduct is established, the Platform may impose financial penalties, suspend or terminate the account, or take any other action it deems appropriate.

12. Disputes and Complaints

In the event of a dispute or complaint between a Seller and a Buyer, RushRooms may request documents, evidence, or information necessary to investigate the matter.

The Seller must fully cooperate with the Platform and provide all requested information within the specified timeframe.

13. Violations and Compensation

If it is determined that a product or service does not match its description, specifications, images, or advertised information, or if fraud, deception, misrepresentation, or concealment of material facts is established, RushRooms may take any action it deems appropriate, including:

  • Removing the product or listing.
  • Temporarily or permanently suspending the account.
  • Refunding the Buyer in full.
  • Canceling the transaction or order.
  • Imposing fines, administrative charges, or compensation.
  • Seeking compensation for damages, losses, or legal claims incurred by the Platform or its users.

If it is determined that a product or service materially differs from what was advertised or was promoted in a misleading manner, the Platform may impose a financial penalty of up to twice the value of the product or service involved in the violation.

A portion of such penalty may be allocated to compensate the Buyer for any damages suffered, while the remaining portion may be retained by the Platform as compensation for operational losses, administrative costs, reputational damage, and loss of trust resulting from the violation.

Nothing in this clause limits the right of the Platform or the Buyer to seek additional compensation or remedies before the competent authorities.

14. Damage to Platform Reputation

The Seller acknowledges that fraudulent, misleading, unlawful, or unethical conduct may negatively impact the reputation of RushRooms, Rush Rooms Real Estate Company, and the trust of its users.

Where the Seller causes direct or indirect harm to the Platform’s reputation, operations, or users, the Platform reserves the right to pursue legal action and seek appropriate compensation.

15. Removal or Rejection of Listings

RushRooms reserves the right to remove, reject, modify, or restrict any listing, product, or service at any time and without prior notice if the Platform believes such action serves its interests, the interests of its users, or is required under its policies or applicable laws.

16. Removal and Archiving of Inactive Listings

The Platform reserves the right to hide, remove, archive, or deactivate products and services that are inactive, outdated, unavailable, or not regularly maintained without prior notice.

17. Taxes, Zakat, and Government Fees

The Seller is solely responsible for all taxes, zakat obligations, governmental fees, and regulatory obligations arising from their business activities, sales, or services.

18. Suspension or Holding of Funds

RushRooms reserves the right to temporarily suspend, hold, delay, or withhold the transfer of funds payable to the Seller in the event of a complaint, dispute, suspected violation, fraud, misrepresentation, non-conforming products or services, or any breach of this Policy, the Terms & Conditions, or applicable laws.

The Platform may retain all or part of the disputed funds until the investigation, verification process, or final determination of the matter is completed.

The Seller shall not be entitled to claim compensation, profits, interest, or damages resulting from the temporary suspension, holding, or delay of payments when such actions are taken for verification purposes or for the protection of users or the Platform.

19. Account Suspension or Termination

RushRooms reserves the right to suspend, restrict, terminate, or permanently close a Seller’s account at any time if the Seller violates this Policy, the Terms & Conditions, applicable laws, or Platform regulations.

20. Limitation of Platform Liability

RushRooms operates as an electronic intermediary connecting Buyers and Sellers and is not considered a party to the contractual relationship between them unless expressly stated otherwise.

Rush Rooms Real Estate Company and RushRooms shall not be responsible for the quality, safety, legality, accuracy, or suitability of products or services offered by Sellers. Such responsibility remains solely with the Seller.

21. Retention of Records and Data

RushRooms reserves the right to retain transaction records, communications, messages, documents, and account-related information for compliance, verification, security, dispute resolution, and operational purposes.

22. Force Majeure

RushRooms shall not be liable for any delays, interruptions, losses, damages, or failures resulting from circumstances beyond its reasonable control, including natural disasters, technical failures, internet or telecommunications outages, governmental actions, cyberattacks, or other force majeure events.

23. Governing Law and Jurisdiction

This Policy shall be governed by and interpreted in accordance with the laws and regulations of the Kingdom of Saudi Arabia.

Any dispute arising out of or relating to this Policy or the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts and judicial authorities within the Kingdom of Saudi Arabia.

24. Amendments

Rush Rooms Real Estate Company reserves the right to amend this Policy at any time.

Continued use of the Platform following the publication of amendments constitutes acceptance of the updated version of this Policy.

25. Acknowledgment

The Seller acknowledges that they have read, understood, and agreed to this Policy, the Terms & Conditions, and all applicable Platform policies, and further acknowledges full responsibility for all activities and transactions conducted through their account.
